Defence, Home Affairs Ministers ordered to pay damages for junior officers’ misconduct

In a landmark ruling, Shurugwi Magistrate Patricia Gwetsayi has ordered Defence Minister Oppah Muchinguri-Kashiri and Zimbabwe National Army Commander Lieutenant-General Anselem Sanyatwe to pay $38,000 to four residents brutally assaulted by soldiers during the COVID-19 lockdown in August 2021.
This courageous decision echoes the spirit of the civil rights movement and demonstrates the Midlands judiciary’s commitment to upholding human rights and holding those in power accountable.
The court heard that torture victims Grant Zinyuke, Moreblessing Ncube, Batler Jabangwe, and Mavhuto Kachepa suffered severe physical and emotional trauma. Their injuries included lost teeth, severe swelling and bruises, fractures, and multiple injuries that hinder daily activities.
Gwetsayi’s ruling sends a powerful message that no one is above the law, and justice will be served regardless of social status or position. This decision is a beacon of hope for Zimbabweans, showcasing the judiciary’s dedication to protecting citizens’ rights.
This ruling follows another significant judgment by Gweru Magistrate Blessing Tsingano, ordering the Mtapa police officer in charge, Zimbabwe Republic Police bosses Godwin Matanga, and Minister of Home Affairs and Cultural Heritage Hon. Kazembe Kazembe to pay $13,000 to a torture victim.
The Midlands Province has seen a surge in justice prowess, with five High Court Judges making landmark rulings recently. Magistrate Gwetsayi’s decision exemplifies this trend, showcasing her bravery and dedication to upholding the law and inspiring victims of unlawful arrests and torture to stand up for their rights.
